Hireko Trading Co., Inc. (“Hireko”) provides the hirekogolf.com Web site (collectively, the “Hireko Site”) subject to your compliance with the terms and conditions below. PLEASE READ THIS BEFORE ACCESSING THE Hireko SITE. BY ACCESSING THE Hireko SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. Rules

While visiting the Hireko Site, you may also not: post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the Hireko Site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Hireko Site or the Internet; post or transmit any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component; upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Hireko Site which is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or rightholder.

Monitoring

Hireko Trading Co., Inc. has no obligation to monitor the Hireko Site. However, you agree that Hireko Trading Co., Inc. has the right to monitor the Hireko Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Hireko Site properly, or to protect itself or its subscribers. Hireko Trading Co., Inc. will not intentionally monitor or disclose any private electronic-mail message unless required by law. Hireko Trading Co., Inc. reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.

Privacy

Hireko Trading Co., Inc. cannot ensure or guarantee privacy for Hireko users. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and Hireko Trading Co., Inc. and its affiliate and related companies shall be relieved of all liability in connection therewith.

Buying over the Internet. When making purchases or other transactions through the Hireko Site or the Internet, but you may also be asked by to supply certain information, Including credit card or other payment mechanisms. You agree that all information you provide through the Hireko Site will be accurate and complete. You agree to pay all charges incurred by you or other users of your account and credit card or other payment mechanisms at the prices in effect when such charges are incurred. You also will be responsible for paying all applicable taxes, if any, relating to purchases on the Hireko Site. Hireko Trading Co., Inc. is in no way responsible for any charges you or any user of your account incurs when making purchases or other transactions in this manner.

Limitation of Liability

Hireko Trading Co., Inc. takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics on the Hireko Site. Further, Hireko Trading Co., Inc. makes no representations about the suitability of any of the information contained in software programs, documents and related graphics on the Hireko Site for any purpose. All such software programs, documents and related graphics are provided without warranty of any kind. In no event shall Hireko Trading Co., Inc. be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available from the service.

Recourse

If you are dissatisfied with the Hireko Site or with any terms, conditions, rules, policies, guidelines, or practices of Hireko Trading Co., Inc. in operating the Hireko Site, your sole and exclusive remedy is to discontinue using the Hireko Site.

Confidential Information

You authorize Hireko Trading Co., Inc. to collect from any party and to retain all relevant information relating to your use of the Hireko Site, and you hereby authorize any party to provide us with such information. You understand and agree that unless you notify Hireko Trading Co., Inc. to the contrary by e-mailing us, you further authorize Hireko Trading Co., Inc. to disclose, on a confidential basis, to any party with whom Hireko Trading Co., Inc. has business relations all relevant information relating to your dealings with us and the Hireko Site.

Indemnity

You agree to defend, indemnify and hold Hireko Trading Co., Inc. and its affiliate and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys’ fees, related to any Violation of this Agreement by you or users of your account, or in connection with the use of the Hireko Site or the Internet or the placement or transmission of any message, information, software or other materials on the Hireko Site or on the Internet by you or users of your account.

Trademarks

Hireko and other names, logos and icons identifying hirekogolf.com, hireko.com and Hireko Trading Co., Inc. products and services referenced herein are trademarks or registered trademarks of Hireko Trading Co., Inc.. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

Miscellaneous

This Agreement, including any and all documents referenced herein, constitute the entire agreement between Hireko Trading Co., Inc. and you pertaining to the subject matter hereof. Hireko Trading Co., Inc.’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement be determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the laws of the State of California and the federal laws of United States applicable therein.

Returns

No returns will be accepted without prior return authorization from Seller. All return shipments must be accompanied by the original or a copy of the original invoice or packing list. All returns must be shipped freight prepaid. No COD shipment will be accepted. Goods returned for any reason other than defective merchandise or mis-shipment is subject to a 15% restocking charge. Only goods which have been purchased within the 12 months period of the returned date will be accepted. The goods must be returned in the same condition as was shipped or no credit will be issued. No returns are accepted for any sale items or items which have been closed out by the Seller.

Address Correction Fees & Other Misc. Shipping Charges

Hireko is not responsible for fees charged by Fedex, UPS, Post Office or other shippers in instances where the customer provides Hireko with incorrect ship to or bill to address information (Street, City, State, Zip Code, etc.). Shipper correction fees will be the responsibility of the customer and the customer will therefore be charged for such fees.

These correction fees are applicable on orders generated from the following sources: internet, email, regular postal mail, fax, edi, or other electronic means.

Orders placed over the telephone are exempt from the above stated correction fees.

Pricing

Hireko Golf does everything we can to ensure that the prices on our website are correct, and we try to keep our prices constant for the calendar year. However, there are times we need to change the cost of a product due to market conditions, or we simply make a mistake. As such, all prices are subject to change without notice and are not guaranteed.

The prices stated do not include any sales, use, or excise tax or any other tax, duty or charge which is now in effect or may be hereafter imposed by any Federal, State, or other authority. All such taxes, duties or other charges shall be paid by the Buyer unless the Buyer provides Hireko Golf with an exemption certificate acceptable to the appropriate authorities.

Prices listed on any other websites may not be accepted. We sell our products through several different online channels, and we cannot always control when they are updated.

Shipping and Warranty

Shipping and warranty may vary by product. Please check the product page for more information. Please note, carriers are taking an inordinate amount of time delivering packages due to COVID-19 and especially during the holiday season. Hireko cannot control nor is responsible for shipping times once the package ships from our warehouse. If you are having an issue with the tracking a package, please contact the carrier directly. NOTE: The tracking information available to Hireko's customer service representatives is the same information you will see on the carriers' websites

Return & Exchange Policy

New Item Return Policy

Hireko will exchange or refund new and unused merchandise within 30 days of purchase accompanied by the original sales receipt. Customer is responsible for freight back to Hireko Golf. Hireko will not exchange or refund partial packs of merchandise including golf balls, ferrules, grip kits, repair tags, specification forms, impact labels, spiral roll and mandrels, replacement hook blades, through bore plugs, screw weights, counterweights, and OEM replacement adapters.

Mis-shipped Item Return Policy

Customer has 10 days to inform us of any mis-shipped products. Hireko will exchange or refund new and unused merchandise within 30 days of purchase. Hireko will pay for the freight of the mis-shipped item back to Hireko. To expedite the process, on occasion Hireko may reship a replacement order prior to physically receiving the return. In the event the mis-shipped merchandise is not returned to Hireko, customer will be billed for the replacement order, including freight.

Address Changes or Incorrect Addresses

It is the responsibility of the buyer to provide an accurate and deliverable shipping address. Please carefully review all the details at checkout prior to completing your order.

If the shipping address was entered incorrectly, and the order has not shipped, please contact customer service immediately to see if the address can be updated. Customer service will advise you of your options once we determine the status of the order.

If the order has shipped and was not able to be delivered, the carrier may send the package(s) back to us. In the event this happens, we will contact you to send the order back out at no cost to the correct address. However, if you decide to cancel the order, they will be issued a 15% restocking fee.

How to Return Merchandise

First, call Hireko at 800-367-8912 or email [email protected] to receive a Return Authorization Number. Hireko Golf will not accept returns on items in the case of customer induced pop-up marks, dings, chips, tire marks, deep scratches, unusual rusting or excessively bent shafts. Wrap the package securely and send it to the following address:

Fine Print

• Hireko will exchange or refund new and unused merchandise within 30 days of purchase accompanied by the original sales receipt.
• Customers are responsible for all associated shipping costs to return base model or upgraded custom golf clubs not covered under Manufacturer’s Warranty.
• Ground shipping will be covered by Hireko Golf on warranty and defective returns only if the defect occurs within 30 days of purchase.
• Hireko Golf will give store credit only on all approved assembled golf clubs returned.
• No COD return shipments will be accepted.
• Merchandise not available for return include: Assembled Boxed Sets, Golf Bags, Headcovers, Pre-owned Golf Clubs, Component Clubs assembled by the customer, Books, Videos and Software, Free or Promotional Goods or Personalized items.
• Items such as grip solvent, grip tape, epoxy, chrome cleaner, rattle trap, lead tape and Dynacraft Lie Fitting Board are not covered by the one-year warranty, but may be eligible for the 30 day replacement.

Personal Information

Your transaction history and the information you provide to us voluntarily on our web site is stored in our customer database. Some of the information we solicit is voluntary, while much of it is required in order to fulfill your order properly. In addition to fulfilling your orders, we use the information that you provide for purposes such as responding to your requests, customizing future shopping for you, improving our service, and communicating with you.

Hireko does not share your name or mailing address with other companies. You may also elect not to receive any future catalogs or other mailings from Hireko. Arbitration

Hireko Trading Company, Inc. ("Hireko") and you agree that any claim or dispute between us or against any officer, director, agent, employee, representative, successor, or assign of the other, including the validity of this arbitration clause, shall be submitted to binding arbitration. This agreement to arbitrate is intended to be broadly interpreted and includes, without limitation, any claims arising out of or relating to any relationship between us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory. Any party who intends to seek arbitration must first send to the other party, by certified mail, a written Notice of Dispute describing (a) the nature and basis of the claim or dispute and (b) the specific relief sought. If Hireko and you do not reach an agreement to resolve the claim within 30 days after the Notice of Dispute is received, your or Hireko may commence an arbitration proceeding. The arbitration shall be administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, available at www.adr.org or by calling 800.778.7879. Any arbitration will take place on an individual basis; class arbitrations and class actions are not permitted. The parties shall appoint one person to hear and determine the dispute. The cost of the arbitration shall be borne by the losing party or in such proportion as the arbitrator shall decide. The sole and exclusive venue for the arbitration and or any legal dispute shall be in Los Angeles County, California.
